General Terms and Conditions (GSP / ÁSZF)
1. Acceptance of Terms
By accessing, browsing, ordering or using our services, you fully accept these General Terms and Conditions (GSP / ÁSZF). If you do not agree, you shall not use our services. These terms are brought to your attention before the conclusion of the order process and are expressly accepted by ticking the checkbox that appears immediately before the payment ("Place Order") button on the checkout page.
2. Order Process
Our order process follows these steps: (a) Browse the products on our website and review the description, condition, price and images shown on each product detail page; (b) Add to cart — the selected product is placed in the shopping cart, which is shared across pages of the website through your browser's local storage; (c) Checkout — on the checkout page you provide the customer and shipping information, choose the shipping method and select a payment method; (d) Review & consent — review the order summary and tick the required checkboxes to accept the Purchase Agreement, Refund Agreement, Customer Information Confidentiality Agreement and these General Terms and Conditions; (e) Place Order — click the "Place Order" button to submit your binding offer together with the payment. The contract is formed only when we confirm and accept your order (see Section 3).
3. Contract Formation
An order placed by the customer constitutes a binding offer. The contract is concluded only once we confirm and accept the order. All transactions are governed solely by these General Terms and Conditions.
4. Pricing & Payment
All prices are final and include applicable taxes unless otherwise stated. Payment must be completed in full before shipment or service delivery. Failed payment or unauthorized chargeback may result in order cancellation and service restriction.
5. Delivery & Risk
Delivery time is for reference only. Risk of loss or damage transfers to the customer upon handover to the carrier. We are not liable for delays caused by logistics, customs or force majeure.
6. Right of Withdrawal (14 Days)
Pursuant to Directive 2011/83/EU on consumer rights (transposed in Hungary by Government Decree 45/2014 (II. 26.)), when you purchase online from PENTE LORI Kft. you have the right to withdraw from the contract within 14 (fourteen) days without giving any reason.
The withdrawal period begins on the day on which you, or a third party designated by you other than the carrier, takes physical possession of the goods. To exercise the right of withdrawal you must inform us by means of a clear statement (e.g. a letter sent by post to the address in the Impressum, or an email to lorantpente15@gmail.com) of your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient for you to send your communication before the withdrawal period has expired.
Effects of withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of any supplementary costs arising from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
7. Special Products – Withdrawal Exemption
Please note that, pursuant to Article 16 of Directive 2011/83/EU, the right of withdrawal referred to in Section 6 does NOT apply to certain contracts. In particular, the right of withdrawal shall not apply to:
- the supply of goods that are made to the consumer's specifications or clearly personalised;
- the supply of goods which are liable to deteriorate or expire rapidly;
- the supply of sealed goods which are not suitable for return on grounds of health protection or hygiene and were unsealed after delivery;
- the supply of goods which after delivery are by their nature inseparably mixed with other items;
- the supply of goods which may, after delivery, deteriorate or expire rapidly, where the consumer is expressly aware of the second-hand or used nature of the goods.
The products offered by PENTE LORI Kft. are vintage, pre-owned, used and, by their nature, one-of-a-kind articles of jewellery. The consumer expressly acknowledges that, due to the special, individualized and second-hand nature of these Products, the 14-day right of withdrawal set out in Section 6 may be excluded where the goods have been unsealed or used after delivery, or where the Product has been clearly personalized or modified. This exemption is an integral part of these General Terms and Conditions (GSP / ÁSZF) and is expressly brought to the consumer's attention before the conclusion of the order process, in particular through the checkbox that must be ticked immediately before the "Place Order" button.
8. Liability Limitation
We shall not be liable for indirect loss, lost profit or consequential damages. No limitation applies to liability for personal injury, fraud or mandatory legal obligations.
9. Prohibited Use
Users shall not abuse services, conduct illegal transactions, interfere with system operation or violate third‑party rights. Violation may lead to account suspension and legal claims.
10. Amendment
We reserve the right to update these terms. Updated versions take effect upon online publication. Continued use of services equals acceptance of revised terms.
11. Governing Law & Jurisdiction
This agreement is governed by the laws of Hungary. Disputes shall be settled by the competent courts of Hungary. The consumer may also bring proceedings in the courts of the Member State in which he or she is domiciled, in accordance with the applicable EU consumer-protection rules.
12. Severability
If any clause of these terms is invalid or unenforceable, the remaining clauses shall remain fully valid and enforceable.
